Traditional jurisprudence relies on either abstract axioms or historical maxims. Irreconcilable problems arise from these two fields. Axioms are apriori, seperated from reality, while maxims are derived from the conquests of antiquity. They were enforced by brute power, are now accepted by many, but not so carefully reasoned.
Another species of proposition is due.
A Probatum (plural: Probata) is a synthetic, atomic proposition designed to fill this gap. It functions like an upgraded maxim, but discards the hubris of antiquity. It is not an unyielding, dogmatic doctrine nor is it a strictly logical first order principle removed from reality; it is an operational philosophy that remains valid in law only so long as its active defense holds.
Probata do not stand on unearned assumptions or blind consensus. Every valid Probatum must be forged through a strict, armored container known as a Treatise of Probatum.
To mint a valid Probatum, an author must construct a bulletproof Treatise satisfying rigorous structural constraints. It cannot rely on nested theorems or floating assertions.
Must be minted by a living agent. Disembodied decrees are rejected; ideas require structural accountability and skin-in-the-game.
Must be singular and self-contained. If the core claim requires compound arguments or external theorems to function, it is reclassified as a Praxiom.
Establishes a clear operational assertion of reality, backed by concrete historical case studies showing the principle in action.
Demonstrates not just that history agrees, but that violating the premise causes predictable, systemic operational collapse.
Explicitly defines the operational limits of the Probatum to prevent overreach into universal abstractions it cannot defend.
Maps out and systematically neutralizes the strongest counter-attacks, sealing the perimeter against intellectual friction.
Extends beyond historical review by incorporating rigorous, foreseeable hypothetical scenarios to prove structural resilience under novel conditions.
Integrates citations and warnings from allied historical or contemporary thinkers, effectively rallying a line of prior authority behind the core thesis.
Because a Probatum is an active, armored unit of law rather than a dead dogma, it is built to be stress-tested. Challenges against a Probatum must follow precise structural vectors rather than vague hand-waving.
Ad hominem challenges are permitted under strict limits. The nature or incentives of the author can be questioned, but this vector can never stand alone to defeat the argument—it serves only to question motives.
The core proposition itself can be directly targeted, or challenged by proposing an alternative, cleaner proposition that captures the same domain with superior precision.
The primary battlefield. Challenges here interrogate the relevance of the historical facts, the empirical evidence backing them, or whether the historical causes truly linked to the stated exigencies.
Substantiation is provided to counter the negative proof by proposing alternative ideologies, data sets, or systems where the historical scenario played out differently without collapse.
Attacking the boundary conditions by demonstrating that the proposition reaches too far, demanding tighter, more restricted parameters for its application.
Targets gaps in defense by refining points where an anticipated counter-argument was not fully resolved, without relying on redundant or previously defeated rebuttals.
Introduces competing hypothetical scenarios or novel future conditions where the Probatum’s logic fractures, exposing unforeseen structural vulnerabilities or failures.
Attacks the author's intellectual coalition by introducing counter-authorities, exposing misinterpretations of cited texts, or demonstrating that historical thinkers elsewhere contradicted the premise.
Individual Probata serve as the atomic particles of the Praxiomatic legal system. When multiple Probata are aligned algebraically to form complex arguments, they become Praxia.
Praxia play a similar role to axioms, but they lend flexibility to the spirit of law. They combine to near complete logical order if for the limited tolerance for exceptions.
These Praxioms are embedded directly into Private Trust indentures—acting as the operational voice of the Genesis Grantor and securing autonomous communities without relying on the coercive fiat of a centralized state.
